If you are registering on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
You represent and warrant that you are at least 18 years of age. Access to our Services is restricted to professional use. The Institute reserves the right to refuse service to any person or entity and change eligibility criteria at any time.
A. Definition: “Content” includes, without limitation, the Executive Portfolio Accelerator Suite, frameworks, reporting templates (Excel, PowerPoint, PDF), data, text, and graphics generated or provided by the Institute. B. Proprietary Rights: All Content provided by the Institute is protected by copyrights, trademarks, and trade secret laws. You shall abide by all copyright notices and restrictions contained in any Content accessed through the Services. C. Limited Use License: Subject to these Terms and successful payment, the Institute grants you a worldwide, non-exclusive, non-sublicensable, and non-transferable license to utilize the Content for your internal professional or organizational use. D. Restrictions: You are strictly prohibited from selling, licensing, renting, distributing, or otherwise exploiting the Content for commercial resale. You may not create derivative works for the purpose of competing with the Institute’s offerings.
Certain Services, including the Executive Portfolio Accelerator Suite, are subject to a one-time payment.
Secure Processing: We utilize Stripe as our third-party payment processor. By choosing to purchase, you authorize the Institute to charge your chosen Payment Method.
Accuracy of Information: You must provide current, complete, and accurate billing information.
No Refunds: Due to the digital nature of our intellectual property, all sales are final upon the delivery of the download link to your professional email.
As a condition of use, you agree not to utilize the Services for any purpose prohibited by these Terms. You shall not:
Decipher, decompile, or reverse-engineer any part of the institutional portal.
Bypass or circumvent any measures used to prevent or restrict access to the Services.
Harvest or "scrape" Content from the portal for unauthorized use.
Our portal may contain links to third-party resources (such as Podia or Stripe). These resources are not under our control, and the Institute is not responsible for the content, functions, or privacy policies of such third parties.
A. Performance: The Services and Content are provided “AS IS” and “AS AVAILABLE.” While our toolkits are modeled after high-fidelity enterprise standards, the Institute does not warrant that the results of using the toolkits will meet your specific organizational requirements or that the Services will function without interruption. B. Liability: In no event shall the Institute, nor its directors or partners, be liable for any lost profits, data loss, or consequential damages arising from your use of the professional Content.
You shall defend and hold harmless the Institute and its representatives from all liabilities and expenses, including reasonable attorneys’ fees, arising from your misuse of the Content or violation of these Terms.
A. Jurisdiction: These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York and the United States of America. B. Arbitration: You agree that all disputes related to these Terms or your use of the Services will be resolved by binding, individual arbitration in the State of New York. You waive your right to participate in a class-action lawsuit.
